Filing a DMCA Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and believe that content hosted on our services infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must be in writing and include the information outlined in the following section.
Upon receipt of a valid DMCA notice, we will:
- Acknowledge receipt of your notice within 2 business days
- Review the claim and identify the allegedly infringing material
- Remove or disable access to the material if the claim is substantiated
- Notify the party responsible for the content of the takedown
- Document the notice for our records
Notice Requirements
To be effective under the DMCA, your takedown notice must include all of the following elements. Notices that are incomplete may not be acted upon.
Required Elements of a DMCA Notice
- Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material — The specific URL(s) or location(s) on our services where the allegedly infringing material is found, with enough detail for us to locate it.
- Your contact information — Your full legal name, mailing address, telephone number, and email address.
- Good faith statement — A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Counter-Notification
If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our designated DMCA agent. This is a legal process — we recommend consulting an attorney before filing a counter-notice.
Upon receipt of a valid counter-notification, we will:
- Forward a copy of your counter-notice to the original complainant
- Inform the complainant that we will restore the removed material in 10 business days
- Restore the material within 10 to 14 business days after receiving the counter-notice, unless we first receive notice from the complainant that they have filed a court action seeking to restrain the alleged infringement

- Identification of the material — A description of the material that was removed or disabled and the URL or location where it appeared before it was removed.
- Good faith statement — A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Brain Trust Publishing may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of that person.
- Your contact information — Your full legal name, mailing address, telephone number, and email address.
- Your signature — A physical or electronic signature.
Repeat Infringers
In accordance with the DMCA and other applicable law, Brain Trust Publishing maintains a policy of terminating access for users who are repeat infringers in appropriate circumstances. If we determine that a user of our services is a repeat infringer, we may take any of the following actions at our sole discretion:
- Issuing a warning to the user
- Temporarily suspending the user's access to our services
- Permanently terminating the user's account and access
- Refusing future service to the user
We consider the severity, frequency, and context of the infringement when determining appropriate action. A "repeat infringer" is any user who has been the subject of more than one valid DMCA takedown notice.
Good Faith & Misrepresentation
We take copyright claims seriously and handle all notices in good faith. However, the DMCA takedown process should not be used to suppress legitimate speech, fair use, or lawful competition.
Please be aware of the following before filing a DMCA notice:
- Fair use: Before submitting a takedown notice, you should consider whether the use of the material qualifies as fair use under 17 U.S.C. § 107. Fair use factors include the purpose of the use, the nature of the copyrighted work, the amount used, and the effect on the market for the original work.
- Licensing and authorization: Please confirm that you have not previously licensed, authorized, or otherwise permitted the use of the material in question.
- Penalties for misrepresentation: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages including costs and attorneys' fees.
We reserve the right to decline to act on notices or counter-notices that we believe, in good faith, to be fraudulent, abusive, or otherwise not in compliance with DMCA requirements.
